California, the eighth largest economy in the world, is broke. "People are going to be hurt starting today," said Hallye Jordan, speaking on behalf of the state Controller. "There's no money."

"Included are $515 million in payments to the state's vendors and $280 million to help people with developmental disabilities. Other public assistance agencies will be left waiting for hundreds of millions of dollars," reports CNN.

"I see the will during the negotiations even though these are very, very tough things that we talk about, where we go into areas that we have never, ever dreamt of going into and trying to solve," said Governor Arnold Schwarzenegger. "So you will be very surprised when the whole thing is done.

But, Chiang, whose office writes the state's checks, says California is about out of stopgap tricks to pay its bills and keep all its programs running.

SACRAMENTO, Calif. (AP) - California's controller says he will begin a 30-day delay on tax refunds and other payments starting Feb. 1 because the state is running out of money.

With a $41.6 billion shortfall over the next year-and-a-half, the state is on the brink of issuing IOUs.

Chiang says his office must continue education and debt payments but will defer money for tax refunds, student aid, social services and mental health programs.

California Attorney General reverses self, asks state high court to overturn Prop. 8

(12-19) 19:25 PST SAN FRANCISCO -- State Attorney General Jerry Brown, in a surprise turnabout, asked the California Supreme Court on Friday to overturn Proposition 8, saying the voter-approved ban on same-sex marriage violates basic rights guaranteed in the state Constitution.

Brown, who is required to defend state laws unless he cannot find reasonable legal grounds to do so, said after Prop. 8 passed Nov. 4 that he would support the initiative before the state's high court.

But in a lengthy filing late Friday, he argued that the measure was "inconsistent with the guarantees of individual liberty" in California's governing charter

The authors of the state Constitution, he said, did not intend "to put a group's right to enjoy liberty to a popular vote."

The court is reviewing lawsuits filed by gay and lesbian couples and by an array of local governments, led by San Francisco, that contend that ballot measure exceeded the legal limits on initiatives by destroying fundamental rights and stripping judges of their authority to protect a historically persecuted minority.

The justices could hear the cases as early as March and would be required to rule within 90 days. Other interested parties on both sides are scheduled to submit written arguments Jan. 15.

Asked why he had changed the position he took after the election, Brown told KCBS radio that since his initial comments, "we've spent weeks researching all the cases, really looking at this law, reflecting on it, going back and forth."

With the help of senior attorneys in his office, he said, he concluded that the public's right to change the Constitution was outweighed in this case by "the duty of the court to protect minorities, to protect the fundamental liberties for which the Constitution is created."

CA Fiscal Crisis: Fed To Rescue?

Schwarzenegger declares fiscal emergency in Calif.

SACRAMENTO, Calif. (AP) - Gov. Arnold Schwarzenegger declared a fiscal emergency Monday and called lawmakers into a special session to address California's $11.2 billion deficit.

The state's revenue gap is expected to hit $28 billion over the next 19 months without bold action. The emergency declaration authorizes the governor and lawmakers to change the existing budget within the next 45 days.

Without quick action, the state is likely to run out of cash in February.

A "breathtaking" ruling from a California appeals court that could subject the parents of 166,000 students in the state to criminal sanctions will be taken to the state Supreme Court.

WND also has reported on concerns expressed by Roy Hanson, chief of the Private and Home Educators of California, about the way the ruling was issued.

Specifically, the appeals court affirmed, the trial court had found that "keeping the children at home deprived them of situations where (1) they could interact with people outside the family, (2) there are people who could provide help if something is amiss in the children's lives, and (3) they could develop emotionally in a broader world than the parents' 'cloistered' setting."

SACRAMENTO – California Gov. Arnold Schwarzenegger has officially approved an assisted suicide measure allowing nurses to sedate, dehydrate and starve depressed or confused individuals they consider to be "terminally ill."

The bill, sponsored by Assemblywoman Patty Berg, a Democrat, passed the California Assembly Aug. 28, and the state Senate Aug. 20. It was signed by the governor yesterday.

"AB 2747 pushes suicide through the back door at the hands of non-physicians taking advantage of depressed patients," he said in a statement. "AB 2747 cheapens the value of human life by endorsing suicide as an option.".

"The bill does not otherwise attempt to expressly define terminal illness that each of these health care professionals would have to diagnose to trigger the offer of counseling end of life option," Tran said. "It is not clear why nurse practitioners and physician assistants could make such a significant diagnosis. It is further not clear from the bill how making such significant diagnoses on a case-by-case basis can be done by such practitioners and assistants based on so-called 'standardized procedures and protocols' not further defined by the bill. The potential effect of AB 2747 is extremely broad and could cause irrevocable harm."

He said the legislation was sponsored by a group called Compassion and Choices, which formerly was known as the Hemlock Society and has advocated for physician-assisted suicide legislation in the past.

Dozens of individuals and groups representing cancer patients, minority rights groups, members of religious communities and hospitals spoke before the Senate Health Committee in opposition to the idea. Also, numerous hospitals and other organizations opposed the measure, includeing California Disability Alliance, California Family Council, California Nurses for Ethical Standards, Mercy San Juan Medical Center, Sierra Nevada Memorial Hospital and St. Mary's Medical Center in San Francisco.

'Nothing in the bill prohibits this horror' (California’s AB 2747 “Terminal Patients’ Right to Know End-of-life Options”)

"AB 2747 allows a physician assistant or a nurse to opine that a patient is 'terminal,' and then push for unnatural death by 'palliative sedation,'" said Randy Thomasson, chief of the Campaign for Children and Families shortly after the vote.

"Depressed patients who succumb to this pressure will be drugged unconscious and die from dehydration, usually within five to 10 days. Nothing in the bill prohibits this horror," he said.

Forty-two Democrats in California voted in favor of the plan: 30 Republicans and two Democrats opposed the plan.

But the final bill "is broad enough to easily include these suicide techniques," Thomasson said.

"The bill does not otherwise attempt to expressly define terminal illness that each of these health care professionals would have to diagnose to trigger the offer of counseling end of life options..."
